Binding Intermediary Agreement
Please read these Terms of Service carefully before purchasing any ticket, booking any slot, or using the BookVelo marketplace platform ("Platform").
By accessing, browsing, or purchasing passes through BookVelo (a registered entity in Puducherry, India), you agree to be legally bound by these terms. If you do not agree to these terms, you must not use our platform or purchase activity tickets through our marketplace.
1. Acceptance of Terms & Age of Capacity
By creating an account or making any booking, you affirm that you are at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872.
If you are purchasing tickets on behalf of other adult companions, family members, or minors, you warrant that you have full legal authority to bind all participants to these Terms. You assume full civil, medical, and legal responsibility for any minors accompanying your booking.
2. Marketplace Scope & Intermediary Role
BookVelo is solely an intermediary technology marketplace as defined under Section 79 of the Information Technology Act, 2000.
BookVelo is NOTa tour operator, carrier, vessel pilot, water sports provider, dive center, vehicle rental agency, event manager, or activity host. We provide a digital discovery, booking, and turnstile validation software connecting travelers with independent, third-party operators ("Partner Operators").
The physical contract for activity execution (boat rides, scuba dives, ATV trails, paragliding flights, club admissions, park entries) exists exclusively between you and the Partner Operator. BookVelo does not own, inspect daily operations of, steer, pilot, or physically control any equipment, vessel, vehicle, or venue grounds.
3. Voluntary Assumption of Inherent Risk
Notice to all participants: High-Risk Adventure Activities
You explicitly understand and acknowledge that participating in tourism and adventure activities listed on BookVelo (including but not limited to boating, ocean transit, mangrove kayaking, scuba diving, deep-sea snorkeling, surfing, ATV trail riding, paragliding, theme park rides, zoo tours, and high-density nightlife events) involves inherent, foreseeable, and unforeseeable risks.
These risks include, without limitation: deep water hazards, ocean currents, tides, sudden weather changes, engine or vessel mechanical failures, collisions, capsize, decompression sickness, altitude hazards, rough terrain falls, equipment malfunctions, bites, panic attacks, bodily injury, permanent disability, and death.
YOU FREELY, VOLUNTARILY, AND KNOWINGLY ASSUME ALL SUCH RISKS. You agree that your decision to participate in any booked activity is made at your own sole discretion and risk.
4. User Health, Safety & Code of Conduct
You agree to comply with all safety instructions, verbal briefings, and rules mandated by the Partner Operator and local governing authorities (e.g., Port Department, Maritime Board, Police, Forest Department):
- Mandatory Safety Gear: You must wear certified life jackets, helmets, diving harnesses, or protective gear at all times as instructed.
- Medical Fitness: You warrant that you do not suffer from any medical condition (including heart conditions, severe asthma, epilepsy, pregnancy, or recent surgeries) that would make your participation hazardous.
- Sobriety & Intoxication: Operating crew reserve the absolute right to refuse boarding/entry without refund to any passenger under the influence of alcohol, narcotics, or behaving aggressively.
- Punctuality: You must report to the operator boarding gate 15 minutes prior to your time window. Missed departures due to customer delay are non-refundable.
5. Payments, Convenience Fees & Taxes
All listed prices include applicable Goods and Services Tax (GST) unless stated otherwise.
BookVelo utilizes certified Level-1 PCI-DSS compliant third-party payment processors (such as Razorpay). BookVelo does not store card numbers, CVVs, or bank credentials. BookVelo may charge a nominal technology convenience fee for processing digital fast-pass manifests, which is non-refundable.
6. Refunds, Reschedules & Weather Disruption
Force Majeure & Weather Halts: If an activity is canceled by the Port Department, Maritime Board, or the Partner Operator due to tides, wind speeds, cyclones, or government restrictions, a 100% refund of the base ticket fare will be triggered back to your source payment method.
Customer Cancellations: Cancellations made more than 24 hours in advance receive a full refund. Cancellations made 12 to 24 hours prior are subject to a 50% slot reservation fee. Cancellations under 12 hours or no-shows are strictly non-refundable as dedicated berths cannot be re-sold.
7. Complete Limitation of Liability
Total Exclusion of On-Ground Physical Harm
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, BOOKVELO, ITS FOUNDERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY:
- Physical injury, illness, bodily harm, trauma, or death occurring at the activity venue, on a boat, in water, or in transit.
- Acts, errors, omissions, negligence, misconduct, or safety breaches of any Partner Operator, captain, pilot, or instructor.
- Mechanical breakdowns, boat capsizing, line snaps, engine fires, or equipment failures during the activity.
- Loss, theft, water damage, or destruction of personal items (cameras, phones, jewelry, wallets).
- Delays, scheduling conflicts, venue closures, or route diversions caused by natural conditions or operator logistics.
Sole Remedy Cap: In the event BookVelo is found liable by a competent court for any technical failure of the marketplace platform, BookVelo's total aggregate liability shall be strictly limited to the total ticket commission fee paid by you for the specific transaction in dispute.
8. User Indemnification
You agree to defend, indemnify, and hold harmless BookVelo, its parent company, subsidiaries, officers, and contractors against any and all claims, liabilities, damages, losses, costs, or legal expenses (including reasonable attorney fees) arising from:
- Your breach of these Terms or safety guidelines.
- Your negligent, reckless, or unlawful behavior at the activity site.
- Any claims brought against BookVelo by your accompanying co-passengers or minors on your booking.
- Any property damage caused by you to operator equipment, vessels, or facilities.
9. Intellectual Property
The "BookVelo" trademark, logo, design system, API architecture, dynamic slot synchronization code, and fast-pass validation systems are proprietary property. Any scraping, unauthorized copying, reverse engineering, or reproduction is strictly prohibited and subject to civil and criminal prosecution.
10. Governing Law, Arbitration & Jurisdiction
These Terms of Service are governed by and construed in accordance with the substantive laws of India.
Any dispute, controversy, or claim arising out of or relating to your use of BookVelo shall first be attempted to be resolved through mutual amicable discussion. If unresolved within 30 days, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996 by a sole arbitrator appointed by BookVelo.
Subject to arbitration, the courts located in Puducherry, India shall have sole and exclusive jurisdiction over all matters relating to these Terms.
